By using the website you accept these terms. If you do not accept them, please do not use the site.
These terms apply to the public Blue Haven website. They do not govern the Blue Haven App, which clause 22 explains, and they do not govern the services we provide to clients, which are covered by the Client Terms of Business and an Engagement Document.
Effective date: September 2026. Clause 24 explains how changes to these terms are handled.
2. Access to the website
Access is provided free of charge and for general information.
We may change, suspend or withdraw any part of the website, and we may add or remove pages, without notice.
We do not guarantee that the website will always be available or uninterrupted. Maintenance, a fault, a hosting problem or an event outside our reasonable control may affect it.
We try to give notice of planned work where a page will be unavailable for any length of time, but we do not promise to.
3. Using the website does not make you a client
Reading our pages, downloading information published on the site, or emailing or telephoning us using the contact details shown, does not by itself create a client relationship with Blue Haven.
A client relationship begins only when we have agreed the scope of the work with you, you have accepted an Engagement Document, and our Client Terms of Business apply to that engagement.
Material published on the website, and an ordinary preliminary or enquiry conversation, are not a substitute for an agreed engagement or for personalised professional advice. Please do not make a material business decision in reliance on general or preliminary information alone, as though we had been engaged. Any liability arising from use of the website or from preliminary information is subject to clause 17, and nothing here excludes liability which cannot lawfully be excluded.
An enquiry is welcome and costs nothing. It simply is not an engagement, and neither of us should treat it as one.
4. What the content is, and what it is not
The website carries general information about business risk, resilience, the services Blue Haven offers, how we work and issues we see across businesses.
It is general information, not personalised professional advice, and it is not tailored to any particular business or situation.
Nothing on the website is to be relied on as legal advice, tax or accountancy advice, insurance advice, specialist health and safety advice, regulated financial advice, cyber security certification, engineering advice or any other specialist or regulated advice.
Where an issue needs that kind of expertise, we say so and we point to the right specialist. That is how we work with clients, and the same boundary applies to what we publish.
Advice tailored to your business is given only under an agreed engagement, and the Client Terms of Business explain what we can and cannot do within it.
5. No guarantee of results
Information on the website does not guarantee savings, lower insurance premiums, a particular claim outcome, regulatory compliance, the prevention of loss, higher revenue, business growth, uninterrupted operation, or reduced risk in any particular case.
Risk work is intended to help reduce exposure. It cannot remove risk entirely, and no article, guide or page on this site changes that.
Any example, figure or scenario we publish is illustrative. Your circumstances will differ.
6. Accuracy and updates
We aim to keep the information on the website accurate and current.
Content can still go out of date. Law, regulation, market practice and business circumstances change, and we may not have updated a page since something moved.
We may update or remove content at any time without notice, and we do not undertake to keep any particular page available.
Please check anything important before you act on it, and ask us if you want to know whether a page still reflects our current view.
Rights and acceptable use
7. Intellectual property
The website and its content are owned by or licensed to Blue Haven Business Advisory Ltd. That includes the written content, graphics, diagrams, images, the Blue Haven name and logo, our branding, our methodology and frameworks, any downloadable material we publish, and the design and code of the site to the extent we hold rights in it.
Those rights are protected by copyright, trade mark and other laws. Nothing on the website transfers any of those rights to you.
Where content is licensed to us by a third party, that party keeps its own rights.
8. What you may do
You may:
- view the website and read its content;
- print or download a reasonable extract for your own reference or for internal use within your business;
- share a link to any page; and
- quote a short extract, provided you say that it came from Blue Haven and link to the page.
When you do any of that, keep any copyright or proprietary notice intact, and do not present the content as your own.
You may not republish our content commercially, resell it, reproduce whole sections of it, use it to build or market a competing service, or suggest that Blue Haven endorses you, your business or your material without our written permission.
9. What you must not do
You must not:
- attack the website, or interfere with its operation or with anyone else's use of it;
- attempt to gain unauthorised access to the site, its server or any connected system;
- introduce a virus, trojan, worm or any other malicious code;
- collect data from the site at a scale or rate which burdens it, or use an automated tool to disrupt it;
- circumvent or attempt to circumvent a security control;
- impersonate Blue Haven, or misuse our name, logo or branding;
- harvest contact details from the site for unsolicited marketing; or
- use the website for anything unlawful.
None of this prevents ordinary use of a browser, or indexing by a legitimate search engine crawling the site in the normal way.
Where we reasonably believe the site is being misused, clause 25 applies.
10. Security research
Please do not test, scan or attempt to exploit a security weakness on the website without our prior written permission.
We appreciate a responsible report. We do not operate a paid vulnerability programme, and this clause is not an offer of a reward.
11. Downloadable material
Where we publish a guide, checklist, report, template or other downloadable material on the website, this clause applies to it.
The material remains subject to our rights under clause 7, and is supplied for general information or for internal use within your business unless the material itself says otherwise.
It is not personalised professional advice, and clause 4 applies to it in the same way as to any other page.
You may not resell it, rebrand it, or make it available as your own or as part of another service, without our written permission.
12. Links from our site
Where we link to another website, the link is provided for convenience or information.
We do not control a third-party site, and we are not responsible for its content, its availability or what it does with your information. The terms and privacy notice of that site apply when you use it.
A link does not automatically mean we endorse the organisation behind it.
Where we recommend a specialist to a client during an engagement, that is a different situation. Those introductions are made under clause 10 of the Client Terms of Business, which explains how they work and who is responsible for what.
13. Linking to our site
You are welcome to link to any public page of the website, provided the link is lawful, does not suggest an endorsement, approval or association which does not exist, does not present our content misleadingly or within a frame on another site, and does not damage our reputation.
Make it clear where the link goes, so a reader knows they are moving to the Blue Haven website.
We may ask you to remove a link which does not meet those conditions, and we ask that you do so promptly.
14. Third-party content
Where we refer to legislation, a regulator, an insurer or broker, a professional body, a specialist or an external resource, we do so for information.
Those sources change. We are not responsible for a change made after we published a page, and a reference is not an endorsement unless we say expressly that it is.
Where accuracy is important to a decision, check the source directly.
Availability, liability and legal terms
15. Availability and technical issues
We are not responsible for a temporary inability to use the website caused by maintenance, a hosting outage, a network failure, a problem with a third-party service, an issue with your device or browser, or an event outside our reasonable control.
Where we know a page will be unavailable, we restore it as soon as we reasonably can.
This clause applies subject to clause 17 and to anything the law does not allow us to exclude.
16. Viruses and security
We take reasonable steps to keep the website secure and free from malicious code.
We cannot guarantee that every page or file is always free from something harmful, because no site can. Please use appropriate security on your own device and browser.
17. Liability
Nothing in these terms limits or excludes our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or for anything else which cannot lawfully be limited or excluded.
Subject to clause 17.1, we are not liable for loss suffered because you relied on general website content as though it were advice for your business, where no engagement between us exists. Clauses 3 and 4 explain that boundary.
Subject to clause 17.1, we are not liable for indirect or consequential loss, for loss of profit, revenue, anticipated savings, business opportunity or goodwill, for business interruption, or for loss caused by misuse of the website.
We are not responsible for a third-party website reached through a link, as clause 12 explains.
Where you are a client, the liability position for the work we do for you is governed by clause 25 of the Client Terms of Business and by the Engagement Document, not by this clause. This clause deals only with use of the website.
Nothing in this clause affects a right you have as a consumer which cannot lawfully be excluded, and clause 19 applies.
18. Business users
The website is aimed at businesses and at people acting for a business.
Where you use the site for a business, you confirm that you have authority to accept these terms on its behalf, and these terms apply to your use of the site.
19. Consumers
The website is primarily business-facing, and our services are provided to businesses.
If you happen to use the site as a consumer, nothing in these terms removes or reduces a right you have under consumer law which cannot lawfully be excluded.
20. Privacy and cookies
Optional analytics is used only where it has been enabled and you have agreed to it, as clause 8 of the Cookie Policy explains.
Both policies are published on the website and form part of the information you should read alongside these terms. Neither is repeated here.
21. Contacting us
Our contact details are published on the website. There is no contact form, so you reach us by email or telephone.
Emailing or telephoning us does not by itself create an engagement, as clause 3 explains. It is the start of a conversation, and we will tell you plainly what would be needed to turn it into a piece of work.
We handle correspondence in accordance with the Privacy Policy.
22. The Blue Haven App
The Blue Haven App is separate from this website.
Use of the App is subject to separate App or subscription terms and to the relevant privacy and data terms, where they apply, and to the Engagement Document under which access is provided.
Access to public website content does not give access to the App, and these terms do not create any right to use it.
23. Changes to the website
We may change the content, add or remove pages, update the design and alter how the website works.
Where functionality changes materially, we review the legal and privacy position before the change goes live, including whether these terms, the Privacy Policy or the Cookie Policy need updating.
That review follows the privacy-by-design process in clause 27 of our Internal Data Protection Policy. In practice it means a new feature does not go live before the wording which describes it.
24. Changes to these terms
We may update these terms when the website or the law changes.
The current version is the one published on the website. A change applies to your use of the site from the date it is published, and we do not apply a change retrospectively.
Where a change is material, we highlight it on the page for a reasonable period.
Effective date: September 2026.
25. Restricting access
We may restrict or block access to the website where that is reasonably necessary to protect the site, to deal with misuse under clause 9, to prevent unlawful activity, or for technical protection.
A restriction is limited to what the situation requires and is lifted once the reason for it has passed.
26. General
If any provision of these terms is found to be invalid or unenforceable, it is treated as modified to the minimum extent necessary to make it enforceable, and the remaining provisions continue in force.
A failure or delay in enforcing any of these terms is not a waiver of the right to enforce them later.
A person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of them.
These terms, the Privacy Policy and the Cookie Policy are the whole of what governs your use of the website.
27. Governing law
These terms, and any dispute or claim arising out of or in connection with them or their subject, including a non-contractual dispute or claim, are governed by the law of England and Wales.
The courts of England and Wales have exclusive jurisdiction.
Where you use the site as a consumer, any mandatory right or protection available to you under the law of your country of residence, including as to jurisdiction, is unaffected.
